Terms of Service

1. Agreement to Terms

By purchasing, accessing, or using any service offered by abetter.host ("we," "us," "our"), you ("Client," "you") agree to be bound by these Terms of Service ("Terms"). These Terms apply to all services including web hosting, web design and development, and website maintenance and support.

If you are entering into these Terms on behalf of a company or organization, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use our services.


2. Services Offered

abetter.host provides the following services, each governed by these Terms and any applicable service-specific agreement or Statement of Work ("SOW"):

  • Web Hosting – Server infrastructure, DNS management, SSL, email hosting, backups, uptime monitoring
  • Web Design & Development – Discovery, design, front-end/back-end development, launch, and handoff
  • Website Maintenance & Support – Ongoing updates, security monitoring, content edits, performance management, technical support

Specific deliverables, timelines, and pricing for each engagement are defined in the applicable SOW, proposal, or plan confirmation sent to you.


3. Account Registration & Client Responsibilities

To use our services you must:

  • Provide accurate, current, and complete account information
  • Maintain the confidentiality of your account credentials
  • Notify us promptly of any unauthorized access to your account
  • Keep your billing information current to avoid service interruption

You are responsible for all activity that occurs under your account. abetter.host is not liable for losses caused by unauthorized access that results from your failure to protect your credentials.


4. Acceptable Use Policy

You agree to use abetter.host services only for lawful purposes. The following are strictly prohibited:

  • Hosting, distributing, or transmitting content that is illegal, defamatory, harassing, obscene, or fraudulent
  • Sending unsolicited bulk email (spam) or operating spam-related services
  • Conducting phishing, malware distribution, or any cyberattack activity
  • Mining cryptocurrency or running resource-intensive scripts that degrade shared server performance
  • Infringing upon the intellectual property rights of any third party
  • Violating the privacy rights of any individual

We reserve the right to suspend or terminate accounts found in violation of this policy. We will make reasonable efforts to notify you before suspension except in cases of severe abuse, security threats, or legal obligations requiring immediate action.


5. Hosting Services

5a. Uptime & Performance

We target 99.9% monthly uptime for all hosting plans. Scheduled maintenance windows will be communicated in advance where possible. Downtime caused by factors outside our control (third-party network outages, force majeure, client-side issues) does not count against uptime guarantees.

5b. Backups

We perform regular backups as described in your hosting plan. Backups are provided as a courtesy and a best-effort safety net — clients are encouraged to maintain their own independent backups of critical data. abetter.host is not liable for data loss in the event of catastrophic failure beyond our reasonable control.

5c. Resource Usage

Hosting plans are allocated specific storage, bandwidth, and computing resources. Sustained excessive usage that negatively impacts other clients may result in a request to upgrade your plan. We will notify you before taking any action.

5d. Client-Owned Infrastructure

All domains, content, and data you bring to abetter.host remain your property. We do not claim ownership over any client content hosted on our servers.


6. Web Design & Development Services

6a. Project Scope

All design and development projects are governed by a written SOW or proposal that defines deliverables, milestones, revision rounds, and timelines. Work outside the agreed scope will be quoted and approved separately before proceeding.

6b. Client Responsibilities

Timely projects depend on timely clients. You agree to:

  • Provide content, materials, approvals, and feedback within agreed timeframes
  • Designate a single point of contact for project decisions
  • Understand that delays caused by late client responses may push project timelines and may incur additional costs

6c. Revisions

Each project includes a defined number of revision rounds as stated in the SOW. Additional revisions beyond the included scope will be billed at our current hourly rate.

6d. Intellectual Property & Ownership

  • Upon receipt of full payment, you own all final deliverables including custom design files, code, and content created specifically for your project
  • abetter.host retains the right to display completed work in our portfolio unless you request otherwise in writing
  • Any third-party assets (stock photos, fonts, plugins, open-source libraries) used in your project are subject to their respective licenses; we will disclose these during the project
  • We retain ownership of any proprietary tools, frameworks, or internal workflows used to build your project

6e. Launch & Handoff

Upon project completion and final payment, we will provide you with all files, credentials, and documentation needed to operate and maintain your site independently. You are not locked in to using abetter.host after a project is complete.


7. Maintenance & Support Services

7a. Scope of Maintenance

Maintenance services are defined by the plan you select. Each plan specifies what is included (e.g., CMS updates, backups, security scans, content edits, support hours). Work requested outside your plan scope is billed at our current hourly rate after written approval.

7b. Response Times

We commit to the following support response times:

7c. Maintenance Exclusions

Maintenance plans do not cover:

  • Custom development or new feature builds (quoted separately)
  • Fixing issues caused by client-made changes outside our scope
  • Third-party plugin or theme conflicts introduced by the client
  • Issues caused by the client's own hosting environment if not hosted with abetter.host

7d. Client Access & Cooperation

You agree to provide necessary access (admin credentials, FTP, DNS, etc.) for us to perform maintenance. Delays caused by withheld access are not our responsibility.


8. Fees, Billing & Payment

8a. Pricing

All fees are stated in USD. Pricing for ongoing services (hosting, maintenance) is charged monthly or annually as selected. Project-based work (design, development) is billed per the SOW payment schedule.

8b. Payment Terms

  • Invoices are due upon receipt unless otherwise specified in the SOW
  • Project work typically requires a 50% deposit before work begins, with the remainder due upon completion
  • Recurring services auto-renew at the end of each billing period unless cancelled per Section 10

8c. Late Payments

Accounts more than 15 days past due may have services suspended until payment is received. We will provide written notice before suspension. Accounts more than 45 days past due may be terminated and data removed after an additional notice period.

8d. Refunds

  • Hosting: Prepaid annual hosting is refundable on a pro-rated basis within the first 30 days. No refunds after 30 days.
  • Design/Development: Deposits are non-refundable once work has begun. Work completed to the point of cancellation will be invoiced.
  • Maintenance: Monthly plans are not refundable for the current billing period. Annual plans are refundable pro-rata within 30 days of purchase.

9. Limitation of Liability

abetter.host is not liable for:

  • Indirect, incidental, consequential, or punitive damages arising from use of our services
  • Loss of revenue, data, or business opportunity due to downtime, data loss, or service interruption
  • Third-party actions, including hacking, DDoS attacks, or upstream network failures beyond our control
  • Issues caused by software or plugins not installed or managed by abetter.host

Our total liability to you for any claim arising from our services is limited to the fees paid to us in the three months preceding the claim.

We do not disclaim responsibility for gross negligence or willful misconduct on our part.


10. Term & Termination

10a. Term

These Terms remain in effect for as long as you use our services.

10b. Cancellation by Client

You may cancel any recurring service with 30 days written notice to hello@abetter.host. Project-based work may be cancelled with 15 days written notice; you will be invoiced for work completed to date.

10c. Termination by abetter.host

We may suspend or terminate services for:

  • Non-payment after notice
  • Violation of the Acceptable Use Policy (Section 4)
  • Abusive or threatening behavior toward our team
  • Legal or regulatory requirement

Where feasible, we will provide 30 days notice before termination (except in abuse or security cases).

10d. Data After Termination

Upon termination or cancellation:

  • Hosted sites will remain accessible for 14 days after the final service date to allow data export
  • We will provide all project files, databases, and credentials within 7 business days of a written request
  • After the 14-day period, data may be purged from our servers

11. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of the engagement. This includes business plans, pricing, client lists, technical configurations, and project materials. This obligation survives termination of the service relationship.


12. Dispute Resolution

If a dispute arises, both parties agree to first attempt resolution through good-faith communication. If unresolved within 30 days, disputes shall be handled through binding arbitration in the state of Texas, under Texas law, before resorting to litigation. Nothing in this section prevents either party from seeking injunctive relief for intellectual property or confidentiality violations.


13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.


14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active clients via email at least 14 days before taking effect. Continued use of our services after that date constitutes acceptance. The current version of these Terms is always available at abetter.host/terms.


15. Entire Agreement

These Terms, together with any signed SOW, proposal, or plan confirmation, constitute the entire agreement between you and abetter.host regarding our services. They supersede all prior agreements, representations, or communications on the same subject.
